Terms of Service
These Terms of Service ("Terms") govern your access to and use of Vouch ("Service"), operated by Vouch ("we", "us", "our"). By creating an account or using the Service you agree to these Terms.
1. The Service
Vouch is an AI-powered video testimonial platform that allows businesses ("Owners") to collect, manage, and publish video testimonials from their clients ("Clients"). Features include campaign management, invite emails, AI-assisted transcription and quote extraction, video processing, and a public profile page.
2. Accounts
- You must be 18 or older and have the legal authority to enter into these Terms on behalf of yourself or your organisation.
- You are responsible for keeping your account credentials secure and for all activity that occurs under your account.
- You must provide accurate registration information and keep it up to date.
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable regulations.
- Upload content that is defamatory, obscene, harassing, or infringes any third-party rights.
- Collect testimonials without the genuine, informed consent of the person giving them.
- Misrepresent testimonials as coming from real clients when they do not.
- Attempt to circumvent any technical measures or access controls.
- Resell or sublicense the Service without our prior written consent.
- Use automated means to scrape, extract, or otherwise access the Service at scale.
4. Intellectual Property
The Vouch name, logo, and all software, designs, and documentation are our intellectual property. Nothing in these Terms transfers any rights in our IP to you.
You retain ownership of the testimonial videos and content submitted through your campaigns. By uploading content to Vouch you grant us a limited, non-exclusive licence to store, process, and display that content solely for the purpose of operating the Service. We do not claim ownership of your content and will not use it for any purpose beyond providing the Service.
5. Client Consent & Data Processing
Owners are solely responsible for obtaining all necessary consents from Clients before collecting video testimonials, including any consents required under applicable data protection law. Vouch provides the technical platform only.
By using the Service to collect personal data from your Clients, you agree to our Data Processing Agreement (set out in our GDPR notice), under which Vouch processes that data on your behalf. See also our Privacy Policy for full details of how we handle personal data.
6. Subscriptions & Billing
- Paid plans are billed monthly or annually as selected at checkout.
- All fees are stated inclusive of any applicable VAT unless otherwise noted.
- Subscriptions renew automatically unless cancelled before the renewal date.
- You may cancel your subscription at any time from your account settings; access continues until the end of the current billing period.
- A full refund is available within 14 days of the initial purchase or first renewal, on request to hello@vouchbusiness.com. No refunds are issued after this window.
- We reserve the right to change pricing with 30 days' notice to existing subscribers.
7. GDPR Rights
If you are located in the European Economic Area (EEA) or United Kingdom, you have rights under the GDPR in relation to your personal data, including the right to access, correct, delete, restrict, or port your data. Please see our GDPR Rights page to submit a request or for further information.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without any warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
9. Limitation of Liability
To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amounts you paid to us in the 12 months preceding the claim. We are not liable for any indirect, incidental, special, or consequential damages.
10. Termination
Either party may terminate the agreement at any time. We may suspend or terminate your access immediately if you breach these Terms. Upon termination, your data will be retained for 90 days before deletion unless you request earlier deletion.
11. Governing Law
These Terms are governed by the laws of the Republic of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you by email and by posting a notice in the dashboard at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance.
